Store Terms of Sale

Merchandise is not software. You cannot try on a download, a parcel can be lost, and a size can simply be wrong. So the store has its own terms — plainer than the software ones, and more generous, because they have to be.

Before anything else

The store is not open yet.

No supplier has been chosen and nothing is priced, so no order can be placed and nothing on this page has been relied on by anybody. It is published now so that it is settled before the first order rather than written in a hurry after it. Where a figure depends on a supplier we have not yet chosen — production time, transit time, shipping rates — it is marked as such instead of guessed.

1. Who you are buying from

Merchandise is sold by Erianux LLC, a Wyoming limited liability company. Items are made and shipped on our behalf by a third-party production and fulfilment partner. Your contract of sale is with Erianux LLC; the partner is our supplier, not yours, and you never need to deal with them.

2. What we sell, and how it is made

The Store carries five kinds of goods: computer accessories (desk mats and similar items), clothing, bags and other accessories, office items, and drinking cups. Every section of this page applies to all five unless a section says otherwise — the hygiene exclusion in section 8 for drinkware is the one real difference between categories.

We hold no stock. Each item is produced after you order it, which is how a small company can offer a full size run without landfilling what does not sell. Two consequences follow, and both are stated again where they matter below: an order can only be cancelled before it enters production, and small variations between one production run and the next are normal rather than defects.

3. Prices, currency and tax

Prices are in US dollars. The price shown at checkout is the price you pay for the goods; shipping is shown separately before you confirm.

Sales tax. We collect sales tax where we are required to. Physical goods and downloaded software are not taxed the same way, so the tax on a hoodie may differ from the tax on a licence bought the same day. The amount is calculated from your delivery address and shown before you confirm.

4. Placing an order

Adding something to a cart is not an order, and an order is not accepted until we send you a confirmation. We may decline an order — for example where an item is listed in error, a price is plainly wrong, or we cannot ship to your address. If we decline after taking payment, we refund it in full.

Check your size before ordering. Every item lists its size run, and a made-to-order garment cannot be resold if it comes back worn.

5. Shipping and delivery

An order takes production time and then transit time. Production begins after your order is accepted; transit begins when the parcel leaves the facility. You receive tracking when it ships.

Production and transit windows, the countries we ship to, and shipping rates are set when the fulfilment partner is chosen, and will appear here and at checkout before the store opens. We would rather leave this blank than publish somebody else's timings we cannot stand behind.

Delivery estimates are estimates. Carriers, customs and weather are outside our control, and a missed estimate is not by itself a failure to deliver. If a parcel is genuinely lost in transit, see section 9 — we replace it.

6. International orders, duties and taxes

On orders shipped outside the United States you may be charged import duty, VAT or a customs handling fee by your own country. Those charges are set by your government, are not ours, and are not included in what you pay us. We cannot predict them and we cannot refund them.

A parcel refused at customs, or returned because duties were not paid, is treated as a return under section 8 and the outbound shipping is not refunded.

7. Cancelling an order

You can cancel for a full refund at any time before the item enters production. Write to shop@erianux.com with your order number and we will stop it if it has not started.

Once production has started the item is being made specifically for you and cannot be cancelled — but you can still return it under section 8 once it arrives.

8. Returns and exchanges

Thirty days, unworn and unwashed.

You may return an item within 30 days of delivery for a refund or an exchange, provided it is unworn, unwashed and in the condition it arrived in, with any tags still attached. Write to shop@erianux.com first — we will give you a return address. Items sent back without contacting us may not be traceable to your order.

Who pays. If the item is faulty, damaged, or not what you ordered, we pay return postage and there is nothing further for you to do. If you simply changed your mind or ordered the wrong size, return postage is yours; we refund the price of the goods once it arrives back with us.

Exchanges. A size exchange is the one we expect most, and we would rather you wore the right size than kept the wrong one. Same 30-day window, same unworn condition.

What cannot come back. For hygiene and safety reasons we cannot accept returns of drinkware that has been used, or of stickers and pins once the backing is removed — unless the item is faulty, in which case section 9 applies and the exclusion does not.

Refunds go back to the original payment method. Your bank decides when it lands; that part is not ours.

This is a different policy from our refund policy for software, and deliberately so. Digital sales are final because you can evaluate the software before paying. You cannot try on a garment, so merchandise gets a real return window. Neither policy affects the other.

9. Damaged, faulty, wrong or lost

If your item arrives damaged or defective, is not the item you ordered, or the parcel is lost in transit, tell us within 30 days of delivery — or, for a parcel that never arrived, within 30 days of the last tracking movement. Send a photograph where there is something to photograph.

We will replace it or refund it, whichever you prefer, and we pay the postage both ways. We will not ask you to argue with the carrier on our behalf.

10. Sizing, colour and variation

Garment measurements are the manufacturer's and are given as a guide. Sizing varies between blanks, so check the size run on the item rather than assuming your usual size carries across.

Screens differ, and dyes differ between production runs. A small variation in shade, print position or finish between what you saw and what arrives — or between two items ordered at different times — is normal for made-to-order goods and is not a defect. Something visibly wrong is, and is covered by section 9.

11. Care

Wash garments cold, inside out, and do not tumble dry hot. Do not iron directly over a print. Drinkware with an etched or printed mark should be washed by hand unless the item says otherwise. Damage caused by washing or drying against these instructions is not a manufacturing fault.

12. Our marks

ERIANUX™ and the Erianux mark are trademarks of Erianux LLC. Buying merchandise gives you the item, not a licence to use our marks: you may not reproduce them, produce your own goods carrying them, or resell our merchandise as though it were your own brand or with our endorsement.

13. What we warrant, and what we do not

We warrant that merchandise is free from manufacturing defects in materials and workmanship on delivery. That is what sections 8 and 9 exist to make good.

Beyond that, and to the extent the law allows, merchandise is sold as described rather than with any further warranty of merchantability or fitness for a particular purpose. Nothing here limits rights you have under consumer law that cannot be limited — and where your local consumer law gives you more than this page does, you get the more generous of the two.

Merchandise is clothing and desk goods. It is not a trading tool, it makes no difference to any trading result, and nothing in the store is investment advice.

14. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to an order of merchandise is limited to the amount you paid for that order. We are not liable for indirect or consequential loss. Nothing in this section limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.

15. Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, and are subject to the same dispute-resolution provisions as our Terms of Service. Where you buy as a consumer, this does not deprive you of the protection of the mandatory law of the country you live in.

16. Changes

We may update these terms. The version that applies to your order is the one published when the order was accepted, and we keep the date at the top of this page current. Changes are never applied backwards to an order already placed.
